UPDATE: 2:30 p.m.

Southampton Town Supervisor Anna Throne-Holst said the town is still working to schedule a special election between January 23 and February 22, 2016.

According to Ms. Throne-Holst, the town was notified of Mr. Bender's resignation via e-mail on Tuesday morning, and she has not spoken to any of the authorities regarding the charges.

"Councilman Bender resigned his position today," she said following an executive session on Tuesday. "We do not know any more than anyone else and we are waiting for word from the authorities."

Ms. Throne-Holst went on to say that business will go on as usual at town hall, but the Town Board will function as a four-member board until the special election is complete.

UPDATE: 1:15 p.m.

Mr. Bender pleaded guilty on Tuesday morning to charges of conspiring to illegally distribute the drug oxycodone.

According to a release from the U.S. Attorney’s office and from information at his arraignment, between July 2012 and June 2015, Mr. Bender received fake prescriptions for the drug from Michael Troyan and filled those prescriptions illegally before exchanging them for cash and steroids with other another unnamed co-conspirator.

As part of his surrender deal, he will be released on a $100,000 bond and must surrender his passport. He will be due back in court for sentencing on April 8, 2016, and is facing a maximum of 20 years in prison and a $1 million fine. According to Judge Anne Y. Shields, if Mr. Bender is sentenced to a term of less than 33 months in jail, he will lose all rights to appeal the sentence.

During the court proceedings on Tuesday, Mr. Bender admitted that he had resigned his post as town councilman on Tuesday morning. He also told the judge that he has been treated for narcotics in the past. After the hearing, Mr. Bender’s attorney clarified that he is addicted to prescription painkillers.

“Mr. Bender is remorseful for his actions,” Mr. DeSessa said in a phone interview. “He let his addiction get the best of him. He is sad and remorseful that he let down the residents and constituents of Southampton Town.”

Assistant U.S. Attorney Allen Bode also said that Mr. Bender was brought in for questioning the day Mr. Troyan was arrested on November 4 and admitted to his participating in the scheme at that time.

“Abuse of oxycodone on Long Island has reached epidemic proportions,” U.S. Attorney Robert L. Capers said in a release on Tuesday. “Councilman Bender’s actions in this oxycodone distribution conspiracy victimized the very community he was entrusted to represent. Today’s guilty plea should serve as a reminder that no one is above the law, including those entrusted with passing our laws.”

UPDATE: 11:45 a.m.

Southampton Town Supervisor Anna Throne-Holst confirmed that Mr. Bender will resign, adding that she was shocked to hear about his arrest this morning.

Ms. Throne-Holst explained that a special election for a new Town Board member will be held within 60 to 90 days.

“My hope would be that we could schedule it as soon as possible, which would be the end of January, so we can have a full board,” she said. “In the meantime, I just want to assure people that we will be conducting business as a Town Board. This is a shock to all of us, but I want to make sure that we will continue to conduct business to the best of our abilities.”

UPDATE: 11:10 a.m.

A representative from the U.S. Attorney’s Office for the Eastern District of New York confirmed that Mr. Bender was scheduled to be arraigned at the Federal Courthouse in Central Islip at 11:30 a.m. on Tuesday morning before Magistrate Judge Anne Y. Shields.

Southampton Town Board members scheduled a special executive session at noon on Tuesday to discuss a report in Tuesday’s Newsday saying Town Councilman Brad Bender has agreed as part of a federal plea deal to resign his office after being charged with buying and reselling prescription painkillers, according to a Town Hall source.

Mr. Bender, who was elected to the board in 2013 as a member of the Independence Party, was discovered as part of the investigation Michael Troyan, a Riverhead-based physician assistant who was arrested earlier this month for illegally distributing oxycodone from his medical practice, Newsday reported.

Mr. Bender did not return calls seeking comment on Tuesday.

According to the report in Newsday, the charges stem from Mr. Bender obtaining illegal oxycodone and reselling or trading the drug for steroids he then used for weight training over a span of three years from July 2012 to June 2015.

It's so unfortunate that those of us in Flanders, Riverside and Northampton finally had an elected from our area that we hoped would truly represent us, and instead he worked behind the scenes to destroy our community. Brad Bender ruined lives and he hurt families (mine included). Beyond that, he used his position of power to intimidate and bully and discredit people with real integrity by resorting to dirty politics. Bender has pled guilty to selling prescription drugs before and during his term as SHT Councilman.

One would hope that this drug dealing elected official serves some real time with other drug dealers like himself. I find it hard to believe that he did this without the knowledge of those around him. What a piece of trash!!!

This means the lame duck Supervisor will not have the necessary 4 votes to place a shopping center on County Road 39.

All those campaign finance contributions to the lame duck Supervisor nullified by another greedy drug dealer posing as a community advocate. Shame on you Mr. Bender.

Why would the people of Southampton support a change of zone that would create more traffic on County Road 39 ?
Why would our Supervisor subject the people that voted her into
office - several times - to this kind of "slow death" ?

Actually it was a Chinese curse referring to periods in Chinese history when a dynasty was in decline or in-between dynasties. Those periods were marked by civil unrest, rioting, etc. As opposed to those periods of strong dynastic control over the middle kingdom.

So it was explained to me and others by a professor of Chinese history who grew up in China as the son of missionary parents and went on to obtain his Doctorate on the subject of China from Harvard University.

Is Throne-Holst talking about two separate realities at the same time? In 60 to 90 days there will be an election to replace Bender - a law breaker. But in the meantime the Southampton Town Board will function as a full board. How can they do so without the right number of members on the board? Please someone explain this to me in plain English?

Will it be a political fiat where they will pass anything they want until a new member is elected?

It will be the same as when Fred Thiele went to the Assembly. Richard Blowes acted as supervisor, without a vote as I recall. 90% of what the board does is basic housekeeping resolutions.

If this guy was willing trading prescription drugs for steroids and cash, it would stretch credulity to believe that he would not likewise trade votes on the board for cash as well. The Town should do a thorough investigation of his votes and other government duties to insure that no other improprieties occurred.

I would say all his votes and activities, including contracts he may have negotiated, should be investigated. Campaign contributions are open and public information already available for public scrutiny. Sure they influence a vote but we have to insure ourselves that there was nothing done under the radar. It may be hard to do, and there may be no there there, but the examination is necessary if just for peace of mind.

This is a very sad story...much like that of other very sad drug-addicted stories. I agree that he harmed people other than himself and that he should be held to a higher standard as an elected official, representing the people. Hopefully Brad's fall will shed more light on the epidemic of drug addiction and we may treat this disease as a disease and a social problem, and not just lock up people. There aren't enough prisons for alcoholics and drug addicts. Get them help and society will be better ...more

We never had such a problem as the drug abuse out east until the first opening of Southampton College in 1968. How nice would it be to have someone like Julie Lofstad on our Town Board. Julie has volunteered on the local school board, founded Untapped Ability to help find jobs for working moms, managed the Port Authority of NY & NJ's multi-million dollar grant program.
She now works in her family's 100 year old Hampton Bays fishing business and has been quoted (and really means it) saying "that we need drinkable, swimmable and clammable" waters.

We are all guilty of the issues you raised in your 2nd paragraph, TB. Some of us more than others, while rabid may be a bit strong, you have fired nasty shots across the bow on occasion.

I too feel bad for Brad. I know the pain of addiction if this is the case. However, Brad betrayed us. I feel the loss of a friend as well as a representative that I thought might be different. It is the Democratic Party not the Democrat Party. The latter name was bestowed by the RNC several years ago as a petty insult. I recall reading that all Republican members of Congress were encouraged to use the new name as often as possible.

When I first met Mr. Bender at the gym I got a bad feeling from him and felt he was creepy - the guy was borderline harassing me and lead to me leaving the gym. Anyone that says they are 'shocked' did not know Mr. Bender.

As for the "I'm an addict" line, BS. Maybe he took them from time to time - but the newsday report indicates that he sold thousands of pills/scripts and the judge made it very clear that he was guilty of dealing and that he was trading ...more

This is very sad and disturbing to hear about. When I knew Brad, he was a very decent fellow and I was quite comfortable with his motives and integrity. It just goes to show that no one is safe from the scourge of addiction.
I am very suspicious of the charges concerning steroids, however. I never observed Brad Bender bulking up or in a "'roid rage" like so many steroid users... this is a terrible day for the people of Bender's district.

We badly need campaign finance reform. Developers contribute to Town Board members and they become spokespersons and zealous advocates for the developers' projects, no matter how intense and great the community opposition which "political prostitutes" as some have called it on 27 East, start treating as inconvenient noise.

PS why is the next highest vote getter not moving into the position now vacated by a confessed drug dealer? why should we pay for an additional" special election" when we have votes from a November election, not more than a few weeks ago. Because this isn't the olympics and you don't just get to "move up" in the standings? There were many candidates for councilperson in this election and the votes were pretty well spread out - now that there is only 1 seat, there should be a special election because the circumstances are different. Who knows, someone completely knew could throw their hat in the ring. Bender was not a candidate in this election. Using the "next best" theory would result in a losing candidate from 2012 being woken up and put in office.
Coat tails and incumbency matter in an election. His seat being empty could have happened under any circumstances, and the vacancy should and will result in a special election.

Drug abuse is so pervasive in our country that even the candidates for president are being confronted with the problem as they campaign in small towns across the country. Apparently we're no different which is difficult to realize when it is so hidden, and very difficult to accept that our beautiful home is so infected. While there is no way I can or will defend a drug dealer, I do feel sorry for Brad that he got caught up in the mess of illegal drugs for whatever reasons.

dnice - this is the same guy who defended the pornographer architect, so, really, no surprise. Furthermore, regardless of once's stance on drugs and if they should be legalized or not, it's the law and it's a very clear law and the councilperson was in violation of the law. AND, opiods result in not only death of users, but major increases in crimes in order to fuel said addiction (which is the type of crime that ironically has been occurring in the northwest part of town).

Even if heroin was legalized, prescription drugs would not be. You cannot use a prescription drug without a prescription, and you can only receive a prescription if it's medically needed. That wasn't the case - Mr. Bender appears to have been getting phony, duplicate, and/or excessive prescriptions and selling the pills for money and steroids. Legalizing drugs would not have prevented this because he was dealing with prescription drugs.

HighHat - Heroin is $5/dose. That's about as cheap as it can get - legalizing it would make it (much) cheaper. The problem with heroin junkies is they want to be high all the time. It is not like marijuana or cocaine or alcohol where you can get high, come down from the high and be ok until tomorrow or next week.
