Attorney: Former Southampton Town Councilman Brad Bender Will Begin Prison Sentence This Week

Former Southampton Town Councilman Brad Bender will begin serving his two-year sentence in federal prison this week, almost 10 months after pleading guilty for his role in an oxycodone drug distribution ring.

Mr. Bender has until noon today, Thursday, September 15, to surrender himself to authorities and begin his incarceration—though it was still unclear as of earlier this week where he would turn himself in. While he will serve his sentence at the United States Penitentiary in Lewisburg, Pennsylvania, Mr. Bender can either turn himself in there or surrender to the U.S. Marshal’s office in Brooklyn, according to his attorney, Brian DeSesa.

He added that as of Monday, Mr. Bender had not yet decided what he would be doing.

Mr. Bender, 55, was sentenced at the federal courthouse in Central Islip earlier this summer, seven months after pleading guilty to felony charges of illegally distributing oxycodone. Since that time, Mr. Bender has paid a $5,000 fine to the courts, and has enrolled in a substance abuse treatment program that he will be required to continue while behind bars.

He previously admitted that he began selling the pills to pay his medical bills stemming from a back injury he suffered in 2011 that, he said, led to his dependence on the painkillers.

Mr. Bender, who has been free since surrendering his passport and posting a $100,000 bond late last year, was arrested in late November in connection to the investigation of Michael Troyan, a Riverhead-based physician’s assistant who was charged with illegally distributing oxycodone from his medical practice, East End Urgent and Primary Care in Riverhead. Mr. Bender admitted to receiving and filling phony prescriptions from Mr. Troyan and illegally exchanging the oxycodone for cash and steroids from July 2012 through June 2015, most of the time he served on the Southampton Town Board.

Mr. Bender was elected to the Town Board in the fall of 2013, taking office on January 1, 2014. He resigned following his arrest in November 2015, and was replaced by Julie Lofstad who won a special election to fill the seat in February.

What about the other 20+ people involved in this drug ring? Where are they? When will they be prosecuted? Or will they just be left to continue dealing drugs with another supplier? Who are they?

Poor Brad his lawyer has been blaming everyone else for his pill and steroid use. The doctor involve could get 9 years for his part, and Brad was the Rat. I would give him 10 years just for the simple fact he was a lying political hack.
