Music Can Ring Out Again At Surf Lodge After Town Strikes Agreement With Owners

East Hampton Town restored a music permit for the Surf Lodge this week after the Montauk business completed sweeping upgrades to the restaurant, bar and motel building.

Despite the fact that the Surf Lodge had been issued several violations of the conditional permits it operated under last year, the Town Board has approved its right to host live music again this summer­—after the owners installed a new low-nitrogen septic system at the property, located on Fort Pond, and renewed a pledge to abide by strict constraints on the crowds and events hosted there.

“We’d agreed that it would be reissued if they complied with the stipulations of the settlement, primary among them the installation of the low-nitrogen septic system, which will be a huge improvement for the water quality of Fort Pond,” East Hampton Town Supervisor Peter Van Scoyoc said. “They had some violations last year, yes, but they have continued to feel the pressure to conform, and I think they’ve made a good-faith effort to meet the conditions of the site plan approvals.”

In 2016, the Surf Lodge reached a settlement agreement with the town that resolved hundreds of violations issued since 2012—Mr. Van Scoyoc said he thinks it was the most ever issued to a business in the town—in exchange for new, specific restrictions on operations there.

The settlement capped the number of people who could be in the bar at fewer than 400 and demanded that live music shows be no longer than two hours and end by 8 p.m. Other bars and restaurants with town music permits may play live music until 9 p.m.

The Surf Lodge’s owners have said that attendance at the bar on Saturdays this summer will be by reservation only, to control the crowds.

Along with making complaints about noise, traffic tie-ups and illegally parked cars, critics of the Surf Lodge’s operation over the years had regularly pointed out that its decades-old septics were likely “failing” and leaching waste directly into Fort Pond.

The pond has suffered from poor water quality in recent years, headlined by blooms of toxic algae that forced the cancellation of the swimming leg of an annual triathlon the last two summers, and nitrogen flowing into the pond from the septic systems of homes and businesses that ring its waters are generally thought to be a main catalyst.

Mr. Van Scoyoc said he thinks the town’s tough stance on code violations at Montauk’s once-unruly bars and restaurants has resulted in a more tame and well-behaved crowd.

“There were no commercial noise violations over the weekend,” Mr. Van Scoyoc said on Monday. “That speaks volumes—if you’ll excuse the pun—about the compliance we are getting out of our commercial establishments.”

That is a lie. The Surf Lodge continues to promote its events on various music websites and continues to utilize club promoters like Tommy Saleh/NY Cult to bring in the hordes. Those who show up without reservations are let in if they are known to Jayma Cardoso or, as in the case of illegal overcrowded share house operators, they generously tip ...more
