Two Arrested For Allowing Underage Drinking In Remsenburg

Jun 21, 2011 12:13 PM

Two men were charged with allowing minors to drink alcohol at a prom house party in Remsenburg early Saturday morning after one teenager had to be rushed to the hospital after vomiting blood, possibly the result of alcohol poisoning, police said.

Southampton Town Police responded to a home on Club Lane at 4:15 a.m. after receiving a call requesting medical assistance, according to a press release issued by the police.

Police learned from the caller, Charles Rothenberg, 20, of Dix Hills, that the Remsenburg home was being rented by students from the Connetquot High School in Bohemia and that the parents of the ailing 17-year-old student were notified and were on the scene when police arrived. Upon arrival at the Club Lane residence, police noticed several Coors beer kegs and “beer funnels” located on the back deck. Police were unable to say how many students were in the house.

Mr. Rothenburg and Richard Fuelling, 46, of Williston Park each were charged with one count of the Social Host Law, a violation. Police said that both men allowed minors to drink with the full knowledge that they were underage. They will be arraigned at a later date, according to police. An incident report filed with the police department states that the two men were charged with providing security for the party.

Police said Mr. Rothenburg was able to be charged under the law even though he is not 21 years old himself, because the law stipulates that those older than 18 years old who allow drinking in a private residence are breaking the law.

First-time offenses of the Social Host Law can trigger a fine of up to $500. Repeat offences are misdemeanors and can result in fines of up to $1,000 and possible jail time. It was unclear if the incident was the first offense for either Mr. Rothenburg or Mr. Fuelling.

The home on Club Lane was rented out for a month, according to police, who noted that both Mr. Rothenburg and Mr. Fuelling were hired by the people who rented the house to ensure that the home was not damaged. The home is owned by Michael Hurley, whose address is listed as a Remsenburg post office box, according to town records. The single-family home has six bedrooms and six bathrooms as well as a pool.

The investigation into the rental of the home is ongoing, according to police.

The teen was transported to Peconic Bay Medical Center in Riverhead by Westhampton War Memorial Ambulance.

Police said that some of the students’ parents picked up their children following the incident.

Maybe they were renting the house out to a number of prom groups over the month. June is an unusual month for a rental.
