Kabot's court date is delayed for a third time

Former Southampton Town Supervisor Linda Kabot will now have to wait even longer for her DWI case to be heard after her trial date was postponed for a third time this week.

Ms. Kabot’s hearing, which had been previously rescheduled for 2 p.m. on Tuesday, January 19, at Riverhead Town Justice Court was canceled with almost no warning. It was not immediately clear why the hearing was rescheduled as neither Ms. Kabot nor her attorney, William Keahon, returned calls this week.

A date for Ms. Kabot’s hearing will be set in the next couple of days, according to the Riverhead Town Court clerk’s office.

Ms. Kabot was arrested by Westhampton Beach Village Police and charged with DWI on Labor Day. Ms. Kabot said during an earlier interview that she refused a breath test and other chemical tests that night because she felt “angry and intimidated” by the “overzealous nature” of the arresting officers.

According to the police report, the arresting officer stated that Ms. Kabot’s breath “smelled strongly of an alcoholic beverage” and her eyes were “red and glassy.” The report also notes that she failed two field sobriety tests.

Ms. Kabot’s first court date was scheduled for October 29, just prior to Election Day. But that hearing was pushed back to December 10 because Mr. Keahon had other court obligations that took priority. The same reason was given for postponing that hearing until January 19.

Ms. Kabot lost her reelection bid to then-Southampton Town Councilwoman Anna Throne-Holst. Ms. Throne-Holst took over the supervisor’s seat on January 1.

Undoubtedly, the delay was at Mr. Kehone's request. This action is a misdemeanor. It will continued to be postponed whenever there is a scheduling conflict with a more serious, i.e. felony, case.

um, excuse me people but i seem to recall that Kabot's attorney asked for at least one of the previous postponements. Once she realized she couldn't make election day hay with her conspiracy theories and innuendo she suddenly wasn't in a hurry for the trial.

I'll leave her alone the moment she leaves us alone and owns up for her role in our financial mess.

This postponement was NOT at the behest of Linda Kabot but, rather, of her attorney, who has a more important action that conflicts. Postponements of this type are s.o.p.

Of course, on the other hand, Kehone's claim shortly after the arrest that he hoped to have the matter disposed of before the Nov. election was pure bovine scatology.

What happened to the claim that her attorney made that this would be cleared up quickly??
Maybe if she did not get her driv. linc. back she would want this to get to trial.

I assume that means you have access to all the "discovery" information?

why should she not have a licence?
Because she refused the test, which results in the loss of ones license regardless of conviction of DWI for a year.

just let linda have her day in court......it won't be that bad......an illegal over here was convicted of dwi....he works for a friend of a friend....my understanding is that he got a 700 dollar fine,thats it................

A breath test is not needed for a conviction, refusal of a breath test is an automatic one year revocation of your drivers license, not taking a breath test is foolish and makes for a very expensive and lenghty process in the court system, if it were so easy no one would take the test. Anyone who refuses a breath test knows they should not of been driving.
