Two Westhampton Men Charged In Sexual Assault Of 14-Year-Old Girl

Two Westhampton men were arrested last month, and several others are the subject of an ongoing investigation, after authorities said they had sex with a 14-year-old girl they met through a cellphone dating app last year.

Westhampton Beach Village Police detectives arrested Terrance Trent, 20, and Jack Martin, 19, at 10:20 a.m. on March 24 at their respective McCord Street homes—they are neighbors, but do not live together—after the girl, who has not been identified, and her family reported the incident to police.

Westhampton Beach Village Police confirmed this week that they are investigating several other potential suspects, noting that Southampton Town Police are also conducting their own investigation focusing on the same underage victim.

On Tuesday, Southampton Town Police Lieutenant Ralph, the department’s public information officer, said the Detective Division is still investigating the case and that no additional arrests have been made.

Mr. Trent was charged with one count each of second-degree rape and second-degree committing a criminal sexual act, both felonies, while Mr. Martin was charged with one count of second-degree committing a criminal sexual act, according to police. Both men were also charged with a misdemeanor count of endangering the welfare of a child, Village Police said.

An individual can be charged with second-degree rape when they are at least 18 and have sex with someone who is younger than 15, or have sex with someone who is incapable of consent because they are incapacitated or mentally disabled. An individual can be charged with second-degree committing a criminal sexual act when they are 18 or older and have either oral or anal sex with a person who is younger than 15 or unable to give consent.

Westhampton Beach Village Police Detectives Ed Hamor and Steven McManus explained that the victim and several family members came to police headquarters on March 24 to report the incident, which they said occurred in mid-December. The detectives said the incident took place in the village, but declined to elaborate further.

Citing the ongoing investigation, Det. Hamor and Det. McManus declined to say if any additional arrests could be pending.

Mr. Martin’s attorney, Colin Astarita, who has a law practice in Southampton Village, said this week that his client and Mr. Trent met the girl through the cellphone app called Tinder, a location-based app associated with Facebook that links mutually interested parties for dating and sex.

Mr. Astarita said his client, Mr. Martin, did not have sex with the girl but did drive his friend, Mr. Trent, to meet her. The attorney said his client then exited the vehicle, leaving Mr. Trent and the victim inside.

It is unclear if the girl was lying about her age, according to Mr. Astarita.

According to the terms of agreement posted on Tinder, people must be at least 13 to register for the app, which is downloaded straight to a cellphone.

“It is an extremely unfortunate situation and, hopefully, this will provide an opportunity for this young lady to be evaluated and get whatever help it is that she needs,” Mr. Astarita said.

Mr. Trent’s attorney, Susan Menu, whose law practice is based in Riverhead, declined to comment on the case when reached this week, only describing the events as a “sad situation.”

Both Mr. Trent and Mr. Martin were arraigned on March 24 before Westhampton Beach Village Justice Robert A. Kelly Jr., where they both entered not guilty pleas. Both men were released after posting $5,000 cash bail.

Both defendants are due back in Village Court on Wednesday, May 25, though it is expected that the case will eventually be transferred to Suffolk County Criminal Court, according to Mr. Astarita.

The attorney intimates in his comment that if the victim lied about her age then his client is perhaps not guilty of a crime? But what person in their right mind has sex in a car with someone they supposedly want to DATE after only meeting & making their acquaintance for the first time ? Even if the female was over 18 - still seems like an assault. What adult of consenting age wants to have sex in a car with a person they just met moments ago? It has pretty much nothing to do with dating...

I'm also curious as to why there is only a photo of one of them. Doesn't seem very fair to me to have his picture on the front of this news story but the other guy is a mystery when both of them were involved.

yeah they should go to jail no doubt, and i agree that there should be a picture of both, but to be honest, lots of girls now lie about thier age. its to the point friend of mine who is single i.d.s people before he makes a move (needless to say he doesnt get far). if she lied about her age, she should be locked up to. get her help sure. but if they prove she lied, she ruined their lifes, there should be a consequence for that. if a 14 year old gets cought with cocaine, he/she goes to juvie. if ...more
