West Hampton Dunes Village, Residents Challenge Authority Of Town Trustees

Seems to me if my house is an eyesore and unsafe it is my responsibility to clear it. Come the next blow down, I think the WHD homeowners should be responsible for their flotsam and jetsam.

Read Sudden Sea about the 1938 Hurricane. In RI those houses were built on the same spit of land as WHD. They were smart enough not to rebuild. Why would we be so dumb?

Also why isn't any new mud/sand called wetlands and preserved as such?" Nov 30, 10 3:19 PM

Flood insurance NEVER pays for the value of the land. That doesn't matter if you are in WHD or anywhere else.

What do the Trustees have to do with the protecting the bay and the beach. My understanding was it was the Army Corp of engineers that did not complete a series of jetties that they promised. Am I wrong?

And how can you say "out of control" when WHD is suing for multiple bank accounts? THAT is out of control!

Do you really believe what you write? Your crap town has no commerce, one stop sign, a rent a cop, and architecture that looks like it's from the SIMS.

Westhampton Beach Considers Buying Portable Ice Skating Rink

I love the idea of a rink but you could never have a real hockey game on it. You can play "shinny" but even then without boards or a snowbank to catch an errant puck it would get frustrating fast. Also the boards must "give" if not you are playing "no check" hockey.

Also check out the attached website http://express-press-release.net/35/Fraud%20Against%20the%20Government%20is%20Rampant%20in%20Vermont%20According%20to%20Court%20Documents.php

Does anyone find irony in the fact that part of the lawsuit focuses on having separate accounts for funds (generally speaking a very good financial practice if and when authorized) and it was "comingling" that got the East hampton Controller in trouble.

Group Pushing For Religious Boundary Files Suit Against Southampton Town, Westhampton Beach And Quogue

Note well "“Our efforts for rational discussion and fair treatment have been met with harsh words and obvious discrimination,” stated Marvin Tenzer, president of the East End Eruv Association, in a press release that accompanied a copy of the lawsuit. “These villages and town are violating our constitutional and civil rights by engaging in an active campaign to obstruct our ability to practice our religion.”

A. if the effort for rational discussion was the You Tube video of the meetin gin the Synagogue than he needs to re-define rational. That was "let me tell you what we are going to do meeting"

B. It was met with an ugly rancor

C. Note how he says villages and towns and not governments. If you substitute the words the aargument has less weight.

here is my issue with lawsuits: they are the ultimate fight. Threats are meaningless once one fails to act on it. Now that they sued there is no room for discussion or negotiation (though you can on the side). Mayor _______ would you be open to an eruv "You know I'd like to comment on an important matter such as that but since we are being sued I'll keep all my comments to myself".

Maybe it's me but if someone just sued me and I KNOW that they have building code violations, I'd be on them so fast to cure them.

But i know these litigant types they'll counter "Why are you giving me grief over the building code violations?"
Answer "because you sued us and brought everything to a head"
Litigant type "but that is a different issue...surely your not going to let that get in the way of a good relationship.

What is she guilty of?

One can say:
1. She's an inattentive if not bad driver
2. The counting thing is bad 13, 14, 15, 13....
3. Inability to follow directions hurts

1. There is no indication she failed the eye exam and even if she did that does not mean she's intoxicated. It may simply mean she's an older person without great peripheral vision (common for eyeglass wearers)
1A It doesn't help staring into cruiser lights and how they flashed the flashlights in her eyes
2. It seems they would have tested her until she failed something. Anyone would be hard pressed to hold their leg up for 13 seconds
3. Most damaging is that the idiot officer stood in front of the video camera

Did she have a drink? yes, the idiot admitted it. Was she intoxicated? Could go either way. Could a good lawyer get her off...you bet! THIS WAS A POORLY EXECUTED ARREST.

I'd argue too that I was right to refuse a field sobriety test because I hadn't overtly failed the eye or walk tests. They are only testing b/c the other two were inconclusive. That is not right. " Feb 2, 11 2:44 PM

I was very quick to point out she was not stellar at all in following directions. Clearly that works against her. Still as you aptly noted the lights and nervousness may be contributing factors.

The circumstantial evidence is not flattering but let me ask a question. If you did not know the circumstances of the stop and did not hear the audio might you think differently? Would it be possible that because everyone in exchange 288 knows this is a DUI arrest, then we are looking for signs of intoxication? if you saw this video without the sound and I told you that you were watching the video of a woman being informed her husband was just killed might you think she was showing restraint and incredible composure?

I do not condone drunk driving. I also am not saying she is not guilty (BTW no one is ever found "innocent"). What I offer is that We and officers are often pre-conditioned as to what we want to believe and our "evidence" is made to support our hypothesis.

Oh and BTW NEVER say you were drinking...ever, then they have to test you. If pulled over...say nothing...ever." Feb 2, 11 5:23 PM

BTW ya know she was going over Turkey bridge to minimize exposure on Montauk Highway. She should have turned left at the Temple. Better yet her defense should be she was on official business trying to figure out where the lechis will go." Feb 2, 11 5:30 PM

Frankly I would be happy if I were her. If there is no tape than it is merely her word against two officers. Now that there is a tape and it is inconclusive in some opinions, ya'd think the WHB PD just did the defense a favor.

And yes, it is circumstantial and not prima facia because it is open to interpretation (albeit not as much as a lack of witness) but it is not a finger print nor a blow test." Feb 2, 11 10:57 PM

Having this video on here is wrong. She's a person with a family and a life. While a public figure that does mean a figure of public ridicule. Like Rex Ryan, you really don't want your kink broadcast to the world now do you? " Feb 2, 11 11:04 PM

I respectfully disagree.

Yes it may be evidence that was seen at a Grand Jury hearing and it may be submitted to trial...but there has been no trial. And until a verdict is rendered, she is presumed innocent. There is still PLENTY of time to cop a plea to a lesser charge or have it dismissed. Just because it could go to trial does not mean it is right for the world to view it.

Frankly it is embarrassing. I for one know if my children were in the car they'd be frightened and concerned at the least...and that is without even describing their ages.

You think there is not detriment to the family? C'mon...the whole dang county has seen this? If she had school age children do you think there would never be some snide comment? I don't think so." Feb 3, 11 1:44 PM

Jury Verdict In Kabot Case: Not Guilty Of DWI

Where i the defensive cross examination?

The ADA asked "But are you involved in a conspiracy to frame Linda Kabot for driving while intoxicated?”

The answer was no!

So from there we have simple questions?

Do you call your family at one in the morning?
Since the answer is likely "no" one would then ask if he is in the habit of calling friends and family to chat at 1AM
NO? So why call ATH?
Are you in the habit of calling ATH after every DUI?
If not why would this be any different?

Rechlers Seeking Amendments To Gabreski Airport Project

to me the whole thing seems scattershot.

- I understand wanting to develop the land. I recall the airport paying some whopping $10K a year in property tax.
- If you are going to develop something the site is there and there is business nearby.
- A hotel makes a bit of sense if you buy into Hank Beck's argument that over the past 6 years many potential hotel/B&B rooms have been lost in the area
- tourist equate to dollars in local businesses.

- a technology park? Really...WHB will be the next Soho? I truly doubt it
- WHB will not be the next Silvercup studios either. Just because you build it doesn't mean anyone cares.
- i've heard casino too. make sense but is an affront to many
- if I were going to haul myself to the Hamptons and pay for a room, I'd like to know I am near water
- the "business" district is not anyplace you'd really shop.

WHB lacks a master plan as to how it wants to conduct itself and be perceived. I offer the following three examples of excellent towns that combine a balance of beauty, functionality, tourist attractions, and commerce: Aspen, Cape May, nantucket

All three towns cater to tourists and residents. They have excellent food, lodging, natural resources etc. WHB is not one of them. " Feb 8, 11 9:14 AM

Amid Change And Turnover, Some Weather The Storm

Dear Editor how is is the posting "their' instead of "there" duplicate or inappropriate?" Feb 9, 11 8:11 AM

The editor seemed not to like my treatise on how difficult the publishing business is. I wonder if there is an agenda of some sorts?

Further to my original post here's the math of a book.

For every $20 book: $5 production costs. $5 marketing, $5 to the publisher, $5 to the author. The price rises if there is a limited market (think college texts) and/or there is a heavy graphics/pics. additionally, if there is an increase in upfront marketing it usually comes at the expense of the authors cut and to a lesser degree the publisher.

You have to sell alot of books to pay the rent and live" Feb 9, 11 8:16 AM

Jurors Continue Deliberation In Guldi Case

Your explanation was certainly clearer than the article above. Maybe it is me though but why would the insurance company name Countrywide just because they have a lien? Or more specifically how the heck would Guldi get Countrywide's signature? It's not like it was ever the corner bank when all this was happening. Seems to me the implication is that a distinct option is to pay down the mortgage versus fixing the house (ahem, the real point of the insurance).

If anyone should be irked it's the insurance company not Countrywide. Usually there is a hook that the check is contingent upon the work actually being completed....." Feb 14, 11 11:23 PM

Guldi Found Guilty Of Two Felony Charges

They most certainly are connected. "Mr. MacPherson will likely be tried alongside an unknown number of other people accused in a massive July 2009 indictment of what prosecutors described as a mortgage fraud ring, including his wife, Carrie Coakley, and former Suffolk County Legislator George O. Guldi, who along with Mr. MacPherson, was accused of acting as a ringleader. Altogether, 17 people were named in the indictment."

It it not known if Guldi has an equity interest in Magic's but it is certain MacPherson does. Additionally, MacPherson is part of this mortgage scam. What is more tenuous is how Magic's closed because of this. MacPherson wouldn't submit the check for the SLA unless he knew he'd get the license. Given the indictment the SLA indicated "no". Therefore; no check and no license.

Now why MacPherson wasn't tried at the same time, is unknown to me. Seems depositing a forged instrument makes you an accomplice." Feb 25, 11 2:16 PM
