It always makes sense to plead "not guilty" b/c if you plead guilty then you go straight to sentencing. At least with a not guilty plea you can bargain to lesser charges or have the less tenuous charges dismissed.

I think from a defense attorney's POV, they do have to defend people that are sometimes indefensible. So how do they live with themselves? In many instances they view it as defending the integrity of the system not so much the character of the defendant.

Do you realize since the inception of this country we have killed via lynching or the death penalty over 15,000 individuals? See Espy File for reference. IMO to err once is as egregious as the defendant's crime. Each of those people deserved the best counsel they could have b/c the nature of their crime (exc. lynching) demanded it. Justice once served was final. Does a lesser crime demand lesser counsel? no.

Our system is funny in that the brother is subject to obstruction if not aiding and abetting. All that is based on misinformation relayed to prosecutors from a conversation over the phone.

Yet if the fugitive's wife (if he has one) had a three hour conversation and she read him the Anarchists Bible, that would be inadmissible b/c it is covered by the marriage privilege (slightly different than lying to prosecutors but you get the notion).

Payroll Error Is Not The First In Westhampton Beach

If what is described is their answer to the error, than WHB needs to clena house ASAP. How many times you are paid per year has no bearing on this type of error. An overpayment occurs when the payroll person prepares a transaction to move cash from the cash account to payroll account (or ADP type service that automatically deducts proper taxes). In no instance is the person who prepares the transaction the person the executes the transaction. once prepared it is reviewed by a comptroller or CFO and a signature is affixed. The transaction is then made. It should be a two signature system!

Additionally failing all that, the sum of the transactions should equal your budget. If you have no turnover (likely in a small gov't) you can almosthit this number to the penny. Any variance to the budget should have been caught in the current year and FIXED.

The only caveat to this scenario is when an employee leaves and has severance. The new employee is on the books and there is in effect one body but double the cost...but severance s/b a different line than salary.

WHB...if you need a primer, I can give you one but the recommendation should be binding (you never want to the same old system justified by the phrase "of course we are doing the right thing we had a consultant come in". Advice is useless unless implemented).

I think the missive is muddled. No one would deny EEH's effort as noble. I have not been a beneficiary of them directly but have had family members in palliative care. We all agree on that.

The sole issue is this the best spot for a commercial enterprise? I think not for two reasons. First it is a large "footprint" of an enterprise near water. If it were any other organization this would not be so well met. Secondly is the rapidly changing scene in Quiogue. In the early 90's I was told that there would NEVER be development on Adam or Jeffrey Lane. Give it 15 years and we have houses there now. 112 meetinghouse is being divided into 4 new houses. When I spoke to the planning Board they were quick to cite that the developer had the right to put up a fifth house given the land usage rules. They were happy! the traffic all exists onto Meetinghouse road.

I agree, that given engineering today you can pretty much build anywhere. The questions is should you? IMHO, if it were solely a residence current land use would say it is fine. Recent events (Sandy/Irene) should cause you to question that.

Now in this instance it is a commercial venture. IMHO again, I do not think Quiogue will benefit from commercial development in that spot, nor given all the proposed/enacted development over the last decade.

Now I prefer to keep the mission of the business out but I will bring it back in. Why would you build a palliative care facility in a flood plain? Many people in Katrina died b/c they had to be moved and they were not strong enough to do so. If this facility existed already you'd have had to evacuate them TWICE in the last 14 months. The point is to die with grace and dignity, not while being transported.

I beg to differ here. It is a business, a not for profit business but much more of a business than a "multi-family house". The people staying there won't list it as a permanent address, won't vote in S'Hampton (unless they were SH residents first) and won't have other members of their family with them.

They will have commercial laundry service, "red bag" refuse, back up generators, etc.

Regardless of EEH's mission, that land is not for commercial use. The exemption should not be given. The necessity for the Multi family designation may be because it needs to conform with land use or maybe it's because the people in it are not getting hospital care but are non-family members co-habitating.

I'd agree that Religion to fill holes in science is absurd. Read "A Connecticut Yankee in King Arthur's Court". That in effect is the essence of the book.

Yet logic woks here. If you found a rock would you say it was divinely placed at that spot? No. Two rocks in a row? No. A string of rocks in a row..maybe but most likely not because our observation is that rocks are usually random and perhaps there was a hand that laid these in a line. What is that line went alway around the earth. Now it is starting to sound like a planned event and not the randomness of nature. Now let's jump to the Universe. We have our solar system and galaxies and billions of stars if not more working in distances our mind cannot readily comprehend using physics understood by few. That sir is probably not random. What ever divine notion one harbors, whatever they believe that role is involved in our daily lives is personal...but the proof is in nature and it is all around us.

I don't think the right phrase is "to buy back 25 unused vacation days 18 months ago". That implies he paid for them in the first place and that transaction didn't happen. Vacation is "awarded" and is usually based on time worked. What happened here is that in lieu of using his awarded days he wanted the commensurate pay.

I have to tell you that most Fortune 500 companies have a "use it or lose it policy". I fail to see why WHB would go against that grain.

I don't know to what level the State's audit was conducted. I would think it was more superficial just based on the notion that they were not physically present (to my knowledge) in the Village.

In publishing they call it "POP" which means publish or perish. The implication is it is final and the further implication is it could contain an error but not one of consequence. I'd hate to think in an audit there was no "final" document.
